TERMS AND CONDITIONS
Effective Date: July 16, 2026 These Terms and Conditions (“Terms”) govern access to www.evoqueprivate.com (the “Website”) and transportation reservation services provided or arranged by Evoque LLC (“Evoque,” “we,” “us,” or “our”). Evoque operates a luxury private transportation reservation platform and a commercial vehicle leasing business. Evoque arranges prearranged private transportation through independent professional chauffeurs, independent operators, and properly authorized third-party transportation providers. Evoque LLC operates under California Public Utilities Commission authority, TCP 42264. By accessing the Website, requesting or confirming a reservation, submitting payment, or using transportation services arranged through Evoque, you agree to these Terms. The person making a reservation accepts these Terms for themselves and represents that they are authorized to arrange transportation for all passengers included in the reservation.
1. Scope of These Terms
These Terms govern: Use of the Evoque Website Requests for quotes Transportation reservations Airport transfers Point-to-point private transportation Hourly transportation Corporate and executive transportation Special-event transportation Related payment and customer-support matters A request for a quote or submission of an inquiry does not create a confirmed reservation.
Commercial vehicle leasing
Commercial vehicle leases or rentals between Evoque and independent lessees are governed by separate written agreements. Nothing in these Terms modifies, replaces, or becomes part of a commercial vehicle lease or rental agreement unless expressly stated in writing.
2. Customer Eligibility
A person making a reservation or submitting payment must be at least 18 years old and legally capable of entering into a binding agreement. By requesting or confirming a reservation, the customer represents that: All submitted information is accurate and complete; The customer is authorized to arrange transportation for the identified passengers; The customer is authorized to use the selected payment method; and The customer and passengers will comply with these Terms.
3. Quotes and Reservation Confirmation
A reservation is confirmed only after Evoque provides written confirmation by email, text message, invoice, or another approved electronic method and any required payment or deposit has been completed. A quote does not reserve a vehicle or guarantee availability. Unless stated otherwise, pricing and availability may change until the reservation is confirmed. Evoque may establish an expiration date for a quote, which will appear on the quote or invoice. Quotes are based on information supplied by the customer, including: Pickup date and time Pickup and destination addresses Number of passengers Expected luggage Vehicle class Requested stops Expected service duration Flight information Special accommodations Final charges may differ when the customer changes the reservation or when the service involves additional waiting time, stops, mileage, service time, tolls, parking, airport fees, cleaning, damage, or other authorized charges.
4. Pricing and Clerical Errors
Evoque may correct typographical, calculation, or clerical errors in a quote, invoice, or reservation confirmation. If correcting an error materially increases the confirmed price, Evoque will notify the customer before service and allow the customer to accept the corrected price or cancel the reservation without charge.
5. Payment Authorization
Reservations may require a valid credit or debit card, advance payment, deposit, or completed invoice before service. By providing a payment method or paying an invoice, the customer authorizes Evoque and its payment processor to charge: The confirmed reservation amount; Waiting time; Approved route changes; Additional stops; Extended service time; Tolls, parking, and airport fees; Cleaning and damage charges; and Other charges permitted under these Terms. When reasonably available, supporting documentation for material additional charges will be provided upon request. All charges are processed in U.S. dollars. The customer is responsible for fees imposed by their financial institution, including foreign-transaction, insufficient-funds, or similar fees. Evoque may suspend or cancel a reservation if an authorized payment cannot be completed.
6. Unpaid Balances
Payment is due according to the deadline shown on the invoice or reservation confirmation. If an authorized payment is declined or an amount remains unpaid, Evoque may suspend or cancel pending reservations and pursue the outstanding balance. To the extent permitted by law, the customer is responsible for reasonable costs incurred in collecting a valid unpaid balance.
7. Gratuity and Additional Expenses
Gratuity is not included unless specifically listed on the customer’s quote, invoice, or reservation confirmation. Tolls, parking charges, airport fees, permits, venue-access charges, and similar third-party costs may be added when incurred and not already included in the confirmed price. Any applicable gratuity, surcharge, or administrative charge will be identified on the quote, invoice, or reservation confirmation.
8. Cancellations
A reservation may be canceled without charge when Evoque receives the cancellation at least 24 hours before the scheduled pickup time. A cancellation received less than 24 hours before the scheduled pickup time will be charged the full confirmed reservation amount. Parking, tolls, additional waiting time, and other expenses that have not been incurred will not be included. Cancellation deadlines are determined using the local time at the scheduled pickup location. Cancellations must be submitted by: Emailing reservations@evoqueprivate.com; or Calling 310-465-5610 A cancellation is effective only when acknowledged by Evoque. If the customer does not receive confirmation, the customer should call before the applicable cancellation deadline. Evoque will not unreasonably withhold or delay acknowledgment of a timely cancellation request.
9. Reservation Changes
Changes are subject to availability and are not effective until confirmed by Evoque. Material changes made less than 24 hours before pickup—including changes to the date, time, route, vehicle class, or service duration—may be treated as a late cancellation and new reservation. Additional charges may apply when a requested change increases service time, mileage, vehicle requirements, or third-party expenses.
10. Special Events and Custom Reservations
Weddings, concerts, award shows, proms, large-group transportation, and other special-event or custom reservations may require a deposit and may have different payment, minimum-service, change, and cancellation terms. Any special terms will be disclosed in writing before confirmation and will control if they conflict with these standard Terms.
11. Airport Grace Periods
The following complimentary grace periods apply: Domestic airport arrivals: 30 minutes after the recorded flight arrival International airport arrivals: 60 minutes after the recorded flight arrival Non-airport pickups: 15 minutes after the scheduled pickup time After the applicable grace period, waiting time will be charged in 15-minute increments based on the hourly rate stated in the customer’s quote or reservation confirmation. Additional airport parking and access expenses incurred during a passenger delay may be added to the final charge.
12. Flight Monitoring
Flight monitoring is provided as a convenience and applies only when the customer supplies accurate commercial airline and flight information. Flight monitoring does not automatically apply to private aviation or non-airport reservations. Customers remain responsible for notifying Evoque of cancellations, diversions, or schedule changes not accurately reflected in publicly available flight information. If accurate flight information is not provided, the grace period begins at the scheduled pickup time. If a flight is significantly delayed, diverted, rescheduled, or canceled, continued service is subject to vehicle and independent-provider availability. Reasonable efforts will be made to accommodate the change, but availability is not guaranteed.
13. Customer Contact Information
The customer must provide accurate contact information, including a mobile telephone number at which the customer or passenger can be reached before and during the reservation. Customers and passengers are responsible for monitoring calls, text messages, and emails concerning: Pickup instructions Independent professional chauffeur contact information Flight updates Delays Service changes Payment or reservation issues
14. Service-Related Communications
By providing a mobile telephone number, the customer agrees to receive non-marketing calls and text messages reasonably necessary to coordinate a quote or reservation. These communications may include confirmations, payment notices, pickup instructions, independent provider contact information, flight updates, delays, and service changes. Message and data rates may apply. Consent to receive marketing communications is not required to purchase services.
15. No-Shows
A reservation may be considered a no-show when the passenger cannot be located or contacted by the end of the applicable grace period: 30 minutes after the recorded arrival of a domestic flight; 60 minutes after the recorded arrival of an international flight; or 15 minutes after the scheduled time for a non-airport pickup. A no-show will be charged the full confirmed reservation amount, plus parking, airport, waiting, or other expenses already incurred. Passengers should contact Evoque at 310-465-5610 before leaving the designated pickup location.
16. Hourly Service
Hourly reservations are billed for the period stated in the reservation confirmation. Minimum booking periods may apply and will be disclosed before confirmation. Service extending beyond the reserved period is subject to availability and may be charged in additional increments at the applicable hourly rate. A customer may not require an independent professional chauffeur to exceed legal driving-hour limitations, violate traffic or parking laws, or enter an unsafe location.
17. Routes, Stops, and Arrival Times
Independent professional chauffeurs may select the route reasonably believed to be safest and most efficient based on traffic, road conditions, closures, and available navigation information. A customer may request a preferred route, but a particular route or arrival time is not guaranteed. Additional time, mileage, tolls, or parking resulting from a customer-requested route may be added to the final charge. Unscheduled stops or destination changes are subject to availability and may result in additional charges.
18. Vehicle Assignments and Substitutions
Evoque will make reasonable efforts to arrange the requested vehicle class. A specific make, model, year, color, independent operator, or individual vehicle is not guaranteed unless expressly confirmed in writing. A comparable or upgraded commercially operated vehicle may be substituted because of availability, maintenance, safety, weather, or other operational circumstances.
19. Passenger and Luggage Capacity
The customer must provide an accurate passenger count and reasonable description of expected luggage. Passengers and belongings may not exceed the legal or safe capacity of the reserved vehicle. If the selected vehicle cannot safely accommodate the passengers or luggage, Evoque may arrange a larger or additional vehicle, subject to availability and additional charges. Service may be refused without a refund when safe transportation cannot be provided because the customer supplied inaccurate information. Luggage may not be placed where it obstructs visibility, prevents seatbelt use, interferes with vehicle operation, or creates a safety hazard.
20. Passenger Conduct
Passengers must behave lawfully and respectfully toward independent professional chauffeurs, independent operators, third-party providers, vehicles, and other parties. Evoque or an independent professional chauffeur may refuse or immediately terminate service without a refund if a passenger: Threatens, abuses, or harasses another person; Uses or possesses illegal drugs; Damages or excessively soils a vehicle; Interferes with safe vehicle operation; Refuses applicable safety requirements; Requests unlawful conduct; or Otherwise creates an unsafe or unlawful condition. The customer remains responsible for the confirmed reservation amount and resulting cleaning, repair, damage, or vehicle-downtime charges.
21. Alcohol Prohibited
Possession of an open alcoholic beverage or consumption of alcohol is prohibited inside all vehicles arranged through Evoque. Service may be refused or immediately terminated if this policy is violated. Service terminated for an alcohol-policy violation will not be eligible for a refund.
22. No Smoking or Vaping
Smoking, vaping, and use of tobacco, cannabis, or similar products are prohibited inside all vehicles arranged through Evoque. A violation may result in immediate termination of service without a refund, together with applicable cleaning, repair, and vehicle-downtime charges.
23. Cleaning and Vehicle Damage
The customer is responsible for reasonable cleaning, repair, replacement, and vehicle-downtime costs resulting from the conduct of the customer, their passengers, or their animals. Charges may apply for: Smoking or vaping; Spilled food or beverages; Vomit or other bodily fluids; Excessive dirt, mud, glitter, confetti, or debris; Burns, tears, stains, scratches, or broken components; and Damage caused by luggage or personal belongings. Charges will be based on the vehicle’s condition and documented professional cleaning or repair costs. Supporting documentation may be provided upon reasonable request.
24. Seatbelts and Safety Requirements
All passengers must use seatbelts and comply with applicable passenger-safety laws and reasonable safety instructions. Passengers may not request that an independent professional chauffeur: Speed or drive unlawfully; Park unlawfully; Exceed the vehicle’s capacity; Use a handheld device while driving; or Disregard applicable safety guidelines. Service may be refused or terminated when a passenger will not comply.
25. Child Safety Seats
Customers must notify Evoque when a child requiring a safety seat will be traveling. Requests for child safety seats are subject to availability and must be confirmed in writing. The accompanying adult is responsible for verifying that the seat is appropriate and, unless otherwise required by law, properly securing the child. Transportation may be refused when it cannot be provided in compliance with applicable child-passenger safety laws.
26. Unaccompanied Minors
Passengers under 18 may not travel without a parent, legal guardian, or responsible adult unless Evoque approves the arrangement in writing before the reservation. The person arranging approved transportation for a minor must be legally authorized to do so and provide accurate emergency contact information.
27. Service Animals
Service animals accompanying individuals with disabilities are permitted as required by applicable law without an additional transportation fee. Advance notice is appreciated when practical so appropriate arrangements can be coordinated, but is not required where prohibited by law. The passenger is responsible for maintaining control of the service animal and for damage beyond ordinary wear.
28. Pets and Other Animals
Pets and other non-service animals may be transported only with advance written approval and are subject to vehicle and independent-provider availability. Animals must be appropriately restrained or contained and may not create an unsafe or unsanitary condition. The customer is responsible for cleaning or damage caused by the animal. This provision does not limit the rights of passengers traveling with service animals.
29. Prohibited and Hazardous Items
Passengers may not bring illegal substances, hazardous materials, explosives, unsecured weapons, or other items that could create a safety risk or damage a vehicle. Service may be refused or terminated when an item is unlawful, unsafe, improperly secured, or unsuitable for transportation. Service terminated because of a violation will not be eligible for a refund.
30. Lost or Forgotten Property
Passengers are responsible for checking that they have collected all personal belongings before leaving the vehicle. To the fullest extent permitted by law, Evoque and independent third-party providers are not responsible for items lost, forgotten, stolen, or damaged. Reasonable efforts may be made to locate and return found property. The customer is responsible for shipping, delivery, storage, independent operator time, and other expenses associated with returning an item.
31. Delays Beyond Reasonable Control
Evoque and independent third-party providers will make reasonable efforts to provide timely service but do not guarantee exact pickup or arrival times. Evoque is not responsible for delays or interrupted service caused by: Traffic or road closures; Weather; Accidents or mechanical issues; Law-enforcement activity; Flight disruptions; Venue restrictions; Natural disasters; Public emergencies; or Other circumstances beyond Evoque’s reasonable control. Customers are responsible for allowing sufficient travel time for traffic, airport procedures, security screening, and foreseeable delays.
32. Missed Flights and Appointments
Customers are responsible for selecting a pickup time that allows sufficient time for traffic, road conditions, airport check-in, security screening, and other foreseeable delays. To the fullest extent permitted by law, Evoque is not responsible for missed flights, connections, meetings, reservations, or events when reasonable transportation efforts were affected by circumstances outside Evoque’s control.
33. Independent Third-Party Providers
Evoque may arrange transportation through independent professional chauffeurs, independent operators, or properly authorized third-party transportation providers. These providers operate as independent business entities and are not employees, joint venturers, or representatives of Evoque. Evoque requires participating providers to represent that they maintain the licenses, permits, and insurance required for the services they perform. Material differences in service policies will be disclosed before service whenever reasonably practicable. References to service quality or safety in these Terms describe platform expectations, contractual requirements, applicable safety guidelines, and industry standards. They do not create an employer-employee relationship.
34. Reservations Made for Other Passengers
A person making a reservation for another passenger represents that they are authorized to provide the passenger’s information, accept these Terms, and arrange transportation on the passenger’s behalf. The person making the reservation remains responsible for payment unless Evoque agrees otherwise in writing and must ensure passengers are informed of applicable conduct, safety, cancellation, and service policies.
35. Reservation Transfers
A reservation may not be sold, assigned, or transferred without Evoque’s prior approval. The customer must notify Evoque of changes to the passenger’s name or contact information before pickup. Evoque may request reasonable identity or reservation verification for safety and fraud-prevention purposes.
36. Third-Party Booking Platforms
Reservations received through a third-party booking, travel, or transportation platform may also be subject to that platform’s payment, cancellation, refund, and customer-support policies. If applicable platform terms conflict with these Terms, the platform’s terms will control only to the extent required for a reservation made through that platform. Questions regarding payments collected directly by a third-party platform must be directed to that platform.
37. Refund Processing
Approved refunds will be issued to the original payment method. Refunds generally take 5–10 business days to appear, but timing may vary based on the customer’s bank, card issuer, payment processor, weekends, and holidays. Once Evoque submits an approved refund, Evoque is not responsible for delays caused by third parties or circumstances outside its reasonable control.
38. Billing Questions and Complaints

Evoque will review the matter and respond within a reasonable period. Nothing in this provision limits consumer rights available under applicable law. Evoque operates under California Public Utilities Commission authority, TCP 42264. Nothing in these Terms limits a customer’s right to contact the California Public Utilities Commission or another appropriate government agency.
39. Accessibility
Evoque is committed to making its Website and reservation services reasonably accessible to individuals with disabilities. Customers who experience difficulty using the Website or need assistance requesting transportation may call 310-465-5610 or email support@evoqueprivate.com.
40. Privacy
Personal information submitted through the Website, booking process, invoices, or communications is handled according to Evoque’s Privacy Policy. The Privacy Policy explains how information may be collected, used, shared, retained, and protected, including information processed through Squarespace, payment processors, inquiry forms, flight-monitoring services, and independent third-party providers.
41. Electronic Communications
The customer agrees that quotes, reservation confirmations, invoices, receipts, policy disclosures, and service-related notices may be provided electronically. Electronic communications satisfy requirements that a communication be provided in writing to the extent permitted by law. Customers are responsible for maintaining accurate email and mobile contact information.
42. Website Use
The Website is provided for lawful informational, inquiry, and reservation purposes. Users may not: Use the Website fraudulently or unlawfully; Attempt unauthorized access to systems or information; Introduce malware or harmful code; Interfere with Website operation or security; Submit false reservation or payment information; or Exploit Website content for unauthorized commercial purposes. Evoque may restrict Website access when it reasonably believes these Terms have been violated.
43. Intellectual Property
Website text, design, graphics, photographs, logos, branding, and other content are owned by or licensed to Evoque and protected by applicable intellectual-property laws. The Website may be viewed for personal, noncommercial purposes. Content may not be reproduced, modified, distributed, sold, republished, or commercially exploited without written permission.
44. Third-Party Services and Links
The Website may use or link to payment processors, mapping services, booking platforms, social-media services, and other third-party websites. Those services are governed by their own terms and privacy practices. Evoque does not control and is not responsible for the content, availability, security, or practices of unaffiliated services.
45. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis. Evoque does not warrant that the Website will always be available, uninterrupted, secure, or error-free, or that all information will be complete or current. Nothing in these Terms excludes a warranty, duty, right, or protection that cannot lawfully be excluded.
46. Limitation of Liability
To the fullest extent permitted by law, Evoque will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Website or transportation services, including lost profits, missed flights, missed events, or lost business opportunities. Nothing in these Terms limits liability that cannot legally be limited, including liability arising from gross negligence, willful misconduct, or another basis that applicable law prohibits the parties from excluding.
47. Indemnification
To the extent permitted by law, the customer agrees to indemnify and hold Evoque harmless from third-party claims, damages, costs, and expenses arising from: The customer’s violation of these Terms; False or inaccurate information supplied by the customer; Unlawful or unsafe conduct by the customer or passengers; Damage caused by the customer, passengers, or animals; or Misuse of the Website. This provision does not require indemnification for Evoque’s own negligence, willful misconduct, or violation of law.
48. Informal Dispute Resolution
Before initiating arbitration, either party must send written notice describing the dispute and requested resolution. Notices to Evoque must be sent to support@evoqueprivate.com. The parties will make a good-faith effort to resolve the dispute informally for 30 days after notice is received. If it remains unresolved after 30 days, either party may initiate arbitration. This requirement does not prevent either party from requesting emergency relief or filing an eligible small-claims action.
49. Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Except for claims eligible for small claims court and requests for temporary or emergency injunctive relief, any dispute, claim, or controversy arising from or relating to these Terms, the Website, a reservation, payment, or transportation service will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. This arbitration agreement applies mutually to the customer and Evoque. The arbitrator, rather than a court or jury, will have authority to resolve the dispute and award any remedy available under applicable law. Arbitration may be conducted by telephone, video conference, written submissions, or in person in Los Angeles County, California, unless applicable AAA rules or law require another reasonably accessible location. Evoque will pay arbitration fees to the extent required by the AAA Consumer Arbitration Rules or applicable law.
No class actions
To the fullest extent permitted by law, disputes must be brought individually and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party seeking relief and only as necessary to resolve that party’s individual claim.
Jury-trial waiver
By agreeing to arbitration, the customer and Evoque waive the right to have covered disputes decided by a judge or jury in court.
Arbitration opt-out
A customer may opt out of this arbitration agreement by emailing written notice to support@evoqueprivate.com within 30 days after first accepting these Terms. The notice must include: The customer’s full name; Telephone number; Email address; and A clear statement that the customer wishes to opt out of arbitration. Opting out will not affect the customer’s ability to use Evoque’s services.
50. Governing Law and Court Venue
These Terms are governed by California law without regard to conflict-of-law principles. For disputes not subject to arbitration, and except where applicable law permits or requires otherwise, proceedings will be brought in a court of competent jurisdiction in Los Angeles County, California.
51. Changes to These Terms
Evoque may update these Terms by posting a revised version with a new effective date. Updated Terms apply prospectively and will not change the terms governing an already confirmed reservation unless required by law or expressly accepted by the customer. Continued Website use after an update constitutes acceptance only where permitted by applicable law.
52. Severability
If a provision is found invalid or unenforceable, it will be enforced to the fullest extent permitted by law, and the remaining provisions will remain effective. If part of the arbitration agreement is found unenforceable, its remaining portions will continue to apply except where applicable law requires otherwise.
53. No Waiver
If Evoque does not immediately enforce a provision, that does not waive the right to enforce it later. A waiver is effective only when made in writing by an authorized Evoque representative and applies only to the specified circumstance.
54. Entire Agreement and Order of Priority
These Terms, together with the applicable quote, reservation confirmation, invoice, Privacy Policy, and written service-specific agreement, constitute the agreement concerning the reservation. If documents conflict, the following order applies: A separately signed agreement; The reservation confirmation; The invoice or accepted quote; and These Terms. Commercial vehicle leases and rentals remain governed by their separate written agreements. These Terms should be interpreted consistently with applicable law. Nothing in these Terms waives a right or protection that cannot lawfully be waived.
